% 12.03.2024 I.A. 5746/2024 (under Order 23 Rule 1 read with Rule 3 along with Section 151 of the Code of Civil Procedure, 1908)

1. This is a joint application under Order 23 Rule 1 of the Code of Civil Procedure, 1908, for withdrawal of the suit filed by the Plaintiff, in terms of the Settlement Agreement dated 26th February, ('Settlement Agreement'), which is annexed with the application.

2. In terms of the Settlement Agreement, both parties have agreed to withdraw all the legal proceedings against each other. The application is duly supported by affidavits of authorised representatives of both the parties. The Settlement Agreement also provides for resolution of any dispute arising from the said Agreement in the event of any breach of the Settlement The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 3. In view of the above, the application is allowed and disposed of. CS(COMM) 261/2018

4. In view of the order passed in I.A. 5746/2024, Ms. Girija Krishnan Varma, counsel for the Plaintiff, wishes to withdraw the present suit and accordingly, the suit is dismissed as withdrawn.

5. The parties shall remain bound by the terms of the Settlement Agreement dated 26th February, 2024.
