IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 1014/2016 NAGHMA SAHAR & ORS ..... Petitioners Through : Mr. Ashish Jha, Adv.

versus GOVERNMENT OF NCT OF DELHI THROUGH DIRECTOR OF EDUCATION ..... Respondent Through :Mr. Peeyoosh Kalra, ASC with Ms.

Sona Babbar and Ms. Swati, Advs.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 02.05.2017 Petitioners' children were not admitted in Nursery Class on the pretext that they were above 4 years of age, in view of the notification issued by the respondent. Petitioners' children are about 41⁄2 years old. Hence, the writ petition.

It is submitted that pursuant to the order dated 5th February, 2016 passed by this Court, petitioners' children have already been admitted in different schools under the general/EWS categories. It is noted that an organisation known as 'Justice for All' has filed a PIL being WP(C) No. 3606/2017 titled Justice for All vs. Govt. of NCT of Delhi before the

Division Bench - I, wherein on 26th April, 2017 Government of NCT of Delhi has already made a statement that upper age limit for Nursery class will stand increased to 5 years, for K.G. to 6 years and for Class 1st to 7 years, for the academic sessions 2017 - 18, as an interim measure. There is no reason to follow the same for the previous year in this case more so when petitioners' children have already been admitted in the different schools and pursuing their studies. No other order is required to be passed. Petition is disposed of.
