The petitioners allege that they have been cheated by Respondent Nos. 3 and 4 on pretext of some investments. They claim that Respondent No. 3 along with other accused persons, induced the petitioners to invest certain amount. 2.

The petitioners claim that the amount was invested in a real estate company in Cameroon. The petitioners seek mandamus to direct the Central Bureau of Investigation to investigate the case.

Concededly, no complaint till date has been given to the Police alleging any cognizable offence. The petitioners are at liberty to file an appropriate complaint before the concerned Police authorities. 5.

Needless to say, the Police in terms of Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is duty bound to register the FIR if the complaint alleges commission of a cognizable offence.

In view of the above, the learned counsel for the petitioners seek liberty to withdraw the present petition and take appropriate steps.
