Learned counsel for respondent/defendant submits that without prejudice to their rights and contentions, they would have no objection if plaintiff/petitioner is granted one last and final opportunity to examine his alleged three witnesses.

Learned counsel for petitioner/plaintiff submits that he would ensure that all three witnesses i.e. Mr. Irshad Alam, Mr. Vishal Bedi and concerned police official are examined by him without any further delay. 3.
Keeping in mind the overall facts and circumstances of the case and the concession given by Ms. Deepika Gawri, learned counsel for respondent/defendant, the present petition is allowed and petitioner/plaintiff is permitted to examine the aforesaid three witnesses. 4.
It is, however, clarified that petitioner would be entitled to only one effective opportunity in this regard and under no circumstance, she would be CM(M) 1488/2023 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. given further indulgence by the learned Trial Court. 5.
For causing delay in the matter, plaintiff/petitioner is also burdened with cost of Rs. 3,000/- which shall be payable to the opposite side on the next date of hearing before the learned Trial Court which is stated to be 08.04.2025.

Present petition stands disposed of in the aforesaid terms. 7.
