% 17.03.2016 By this writ petition, petitioner has prayed that North Delhi Municipal Corporation (respondent no.1) be directed to demolish the entire illegal and unauthorised construction raised on the public road and drainage in south side of petitioner's property bearing no. A-133, Majlis Park, Azadpur Mandi, Delhi - 110033.

On 31st July, 2015 Delhi Jal Board (respondent no. 4) made a statement that area was inspected and no encroachment over the sewage line was found.

It was further stated that drainage pipe in question was not of respondent no. 4. Respondent no.1 has also filed counter affidavit stating therein that the site was inspected by the field staff when unauthorised

construction was noticed in the property bearing no. A-134, Majlis Park, Delhi of Smt. Raj Bala Gupta (respondent no. 5). The unauthorised construction was in the shape of deviations against the sanctioned building plan. Such deviations in the construction were booked on 26th March, 2014 and demolition order was passed on 7th April, 2014. It has been further stated that one toilet at stilt floor and one panel at the roof of third floor were demolished.

In view of the action taken report and the statement made by the counsel for the respondent no.4, I am of the view that no further orders are required to be passed in this writ petition. Writ petition is disposed of. A.K. PATHAK, J.
