This bail application has been filed seeking anticipatory bail in FIR No. 170/2024, registered at PS Ghazipur, Delhi under Sections 306/34 IPC. 2.

The petitioner was on interim protection by order dated 05th June, 2024. 3.

The allegation is regarding a death of the deceased Gaurav who was staying as a tenant at the petitioner's premises. 4.

In the intervening night of 07th April, 2024 and 08th April, 2024, PCR call was received alleging rape of 15-year-old daughter of the petitioner by the tenant (now deceased).

The police team reached and found that Gaurav was hanging from the ceiling fan. The door was locked from inside. 6.

Investigation has now been transferred to the Crime Branch. 7.

investigation.

Counsel for petitioner states that in fact the rape complaint preceded the suicide by the deceased, and they undertake to join and cooperate in the investigation, as and when summoned by the IO. 9.

In light of the above, the Court is of the considered opinion that the petitioner is entitled to anticipatory bail. Consequently, in the event of arrest the petitioner be released on bail on furnishing a personal bond in the sum of Rs. 25, 000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case. 10.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous 11.

In the event if petitioner does not cooperate in the investigation, State is at liberty to approach the Court for suitable directions. 12.
