Petitioner has approached this Court seeking bail in the event of arrest in FIR No.336/2024, dated 08.05.2024, registered at Police Station Sagarpur for offences under Section 5 of the Immoral Traffic Prevention Act, 1956. 2.
The facts of the case reveals that on the intervening night of 0708.05.2024, a secret information was received at Police Station Sagarpur that a girl is in distress condition at Dashrathpuri. It is stated that when the Police reached the spot they found the victim, who is 22 years of age, along with two other women, one of whom is one of the accused in the present case. into prostitution in the pretext of earning extra money. It is stated that during investigation the name of the Petitioner herein was figured. 3.
Petitioner approached this Court seeking bail in the event of arrest. On 05.06.2024 it was stated by the Investigating Officer that the co-accused - Rajni, has joined investigation and she has not been arrested. On the statement of the learned Counsel for the Petitioner that the Petitioner will also join investigation, this Court directed that no coercive action be taken against the Petitioner. It transpires that pursuant to the said Order the Petitioner has joined investigation on 10.06.2024. The Status Report reveals that the Petitioner has stated that women come to him for job in spa and he only gets them employed in spa.

In the considered opinion of this Court, the custody of the Petitioner is not required for the reason that the co-accused, who has got a similar role, has also not been arrested by the Police. Petitioner is, therefore, entitled to parity with the co-accused.

In view of the above, this Court is inclined to grant bail to the Petitioner in the event of arrest in the present FIR. In case the Petitioner is arrested, he shall be released on bail on furnishing a personal bond in the sum of Rs.50,000/- with two sureties of the like amount to the satisfaction of the SHO/Investigating Officer and further subject to the following conditions:
a) The Petitioner shall co-operate with the investigation and in case charges are framed, the Petitioner shall appear before the Court on every date of hearing.

c) The Petitioner is also directed not to leave the city of Delhi till further orders.
d) The Petitioner is directed not to indulge in the business of spa or any other related business.
e) The Petitioner is directed to give him mobile numbers to the Investigating Officer and keep them operational at all times. f) In case of violation of any of the conditions, the bail granted to the Petitioner shall be liable to be cancelled.
