It appears that on medical grounds, interim bail was sought by the petitioner, which was being extended by the predecessor benches time to time. It also appears from order dated 05.11.2024 that the medical board which examined the petitioner reported that the tumour in the leg of the petitioner stands cured and is not likely to recur. There is also a report dated 08.11.2024 (PDF 110) on record from Jail Authorities that the petitioner did not surrender within time.

On being pointed out that the interim bail sought was only for three months, which period expired long ago, so the application has become infructuous, learned counsel for petitioner seeks permission to withdraw this application with liberty to file fresh exhaustive application for bail on merits or medical grounds.
