BAIL APPLN. 2221/2019 2.

The petitioner has filed the present petition, inter alia, praying that he be admitted to bail in FIR No.0503/15 under Sections 395/397 of the IPC registered with PS New Friends Colony. The said FIR was lodged regarding a robbery, which had been committed in the house of the complainant. It is alleged that the said robbery was committed by four persons who had entered the house in collusion with the domestic help who had been engaged by the complainant earlier. The petitioner was not one of the four persons who had entered the house. However, it is alleged that he was a part of the conspiracy and his role was to keep a watch outside the house. It is also alleged that he had recced the area earlier and had also master minded the

operation.

Apart from the disclosure made by the persons who are co-accused, it appears that there is no other evidence against the petitioner. In any view, the petitioner has been in custody since 17.06.2016. 4.

In view of the above, this Court considers it apposite to allow the present petition. The petitioner is directed to be released on bail a Personal Bond in the sum of ₹50,000/- along with one local surety of the like amount the satisfaction of the concerned trial court. This is subject to the following further conditions:

a) The petitioner shall not leave the National Capital Territory of Delhi and also surrender his passport, if not already done, to the concerned trial court.

b) The petitioner shall not contact the complainant or any of the witnesses.

c) The petitioner shall also not try to influence, either directly or indirectly, any of the witnesses in this case. d) He shall also provide his contact details to the concerned SHO and ensure that it is reachable at all times.

e) He shall also appear before the trial court on all dates of hearing. 5.

Needless to state that if any of the aforementioned conditions are violated, the bail granted to the petitioner shall be cancelled. 6.
