After arguing at some length, learned Senior Counsel representing the appellant states that this appeal may be permitted to be withdrawn with liberty to pursue the proceedings of the writ petition pending before the learned Single Judge.

Accordingly, the appeal is dismissed as withdrawn with the aforesaid liberty.
