Further to the order dated 07.05.2024, learned counsel for the parties confirm that possession of the suit premises has been handed over by the defendant to the representative of the plaintiff. 2.

As learned counsel for the defendant states that the defendant does not claim any title and interest in the suit property, Mr. Sudipto Sircar, learned counsel for the plaintiff, seeks permission to withdraw the suit. 3.

The suit is dismissed as withdrawn. All pending applications also stand disposed of.

As the suit has been withdrawn prior to recording of evidence on these grounds, the Registry is directed to refund half of the court fee to the plaintiff under Section 16A of the Court Fees Act, 1870.
