The present application under Section 439 Cr.P.C has been filed on behalf of the applicant seeking interim bail in FIR No. 79/2019 registered at P.S. Krishna Nagar for the offences punishable under Sections 302/120B/34 IPC and Sections 25/27 of the Arms act.

Learned counsel appearing on behalf of the applicant submits that the wife of the petitioner has been advised surgery for which he needs to get her admitted on 15.06.2024 at Jain Charitable Hospital, Raghuvar Pura, Gandhi Nagar, Delhi.

Learned counsel for the applicant assures the Court that the applicant's wife's surgery will be conducted and the latter shall not ask for interim bail on that account.

In view thereof, the applicant is directed to be released on interim bail for a period of 10 days from the date of his release, on his furnishing a personal bond of Rs.50,000/- with one surety of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions:
i.
The applicant shall not leave India without prior permission of the learned Trial Court.
ii.
The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address.
iii.
The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing.
iv.
The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v.
The applicant shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner.

The application is partly allowed and disposed of accordingly. 7.
Pending applications, if any, also stand disposed of. 8.
Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
