Counsel for Respondent has stated that his Reply and all the objections mentioned in previous Reply to the OMP(E)(COMM) 2/2025 may be considered in the present petition also. Detailed order dated 25.02.2025 has been passed by the Ld. Joint Registrar (Judicial) on the said objections.

Ld. Counsel for plaintiff has stated that vide this petition, he wants to summons one witness as mentioned in para no. 3(s) of the petition. Heard. The petition stands allowed. Summons be issued to the witness as mentioned in the petition on filing of PF by all permissible modes including electronic mode. The witness is directed to appear physically at the time, date and place as mentioned in the prayer clause of the petition i.e. 25.07.2025 before the Ld. Arbitrator with requisite record. Diet money be paid at the spot.

Ld. Counsel for petitioner has stated that on previous dates also, summons were issued to the witness but Registry had issued summons very late due to which the witness could not appear from Pune. At request, the concerned official of Registry is directed to issue summons to the witnesses at all the given address immediately on filing of PF by the petitioner so that the witness is given due notice for making arrangements for appearing before Ld. Arbitrator. The Petition as well as I.A.14441/2025 stands disposed off. File be sent back to the concerned official of Registry for consignment.
