This Court, vide Judgment dated 05.08.2025, held Respondent No.2 guilty of the offence punishable under Section 138 of the Negotiable Instruments Act, 18811.

The matter is listed today for hearing on the quantum of sentence.

At the outset, learned counsel for the Appellant, on instructions, submits that as the Appellant is a senior citizen aged about 82 years, and considering both the relationship between the parties and the fact that Respondent No. 2 is also an elderly lady, the Appellant would be satisfied if the sentence is confined to the monetary aspect alone. 4.

Learned counsel for the Appellant further submits that if Respondent No. 2 is directed to pay only fine, which may extend to twice the amount of the cheque as contemplated under Section 138 of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the NI Act, the Appellant would have no objection to the sentence being confined accordingly.

In response to the Appellant's submission, learned counsel for Respondent No. 2, on instructions, undertakes that Respondent No. 2 shall pay a sum of Rs.10,00,000/- (Rupees Ten Lakhs only), being double the cheque amount, to the Appellant by way of a Demand Draft in favour of the Appellant within a period of two months from today.

The undertaking given by learned counsel for Respondent No. 2 and as accepted by the counsel of the Appellant is taken on record. 7.

In view of the undertaking, the Appeal alongwith pending application(s), if any, stands disposed of.
