1. By way of the present appeal filed under Order XLIII Rule 1 CPC, the appellants assail the judgment and order dated 06.09.2023 passed by the learned ADJ-07, Tis Hazari Courts, Delhi in CIV DJ No. 716/2023. 2.

At the outset, learned counsel for the parties jointly submit that the impugned judgment was passed relying upon the decision dated 01.06.2022 in CM(M) 69/2020 titled 'Avneet Kaur v. Sadhu Singh & Anr.' which has been set aside.

In view of the aforesaid, the impugned order is set aside and the matter is remanded back for fresh consideration. 4.

The appeal along with pending applications is disposed of in above terms.
