The present Petition under Articles 226 and 227 of the Constitution of India has been filed on behalf of the petitioner seeking directions to prohibit the respondent from issuing the Sale Certificate against the property in question to the bidder and to set aside the auction Notice issued by the respondent vide Notice dated 10.05.2024 and to stay the auction proceedings as well as direction to the respondent to return an amount of Rs. 1.05 deposited in lieu of Resolution Plan, if respondent wishes to auction the property in question.

already stands concluded and the Sale Certificate has already been issued on 06.06.2024.

In view of the submissions made, the present petition has become infructuous, which is accordingly dismissed.

However, the petitioner is at liberty to seek release of the money which may have been deposited with the respondent in accordance with law.
