O.M.P.(MISC.)(COMM.) 451/2025 & O.M.P.(MISC.)(COMM.) 452/2025 1.

These petitions are filed on behalf of the Petitioner under Section 29A

(4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the 3-Member Arbitral Tribunal. 2.

Petitioner/Concessionaire is a Special Purpose Vehicle Company and entered into a Concession Agreement with NHAI for the purpose of development of Panipat-Jalandhar section of NH-1 from Km 96.00 to Km 387.100 in the State of Haryana and Punjab, to be executed on Design, Build, Operate, Finance and Transfer (DBFOT) basis the design, build, operate, finance and transfer pattern under NHDP Phase-V. NHAI on 29.11.2006 invited Tenders and shortlisted, amongst others, ISOLUX CORSAN-SOMA consortium comprising M/s Isolux Corsan Concesiones S.A., M/s Corsan Corviam Construccion S.A. and M/s Soma Enterprise Limited (consortium) with M/s Isolux Corsan Concesiones S.A., being the lead member of the consortium. It is stated that the Petitioner and the Claimant are engaged in two arbitration proceedings simultaneously named as AT-2 and AT-3 before a common Arbitral Tribunal. 3.

O.M.P.(MISC.)(COMM.) 451/2025 is in respect of Arbitration AT-2, in which the award has been reserved and mandate expires on 08.07.2025. O.M.P.(MISC.)(COMM.) 452/2025 is in respect of Arbitration AT-3, where the arbitral proceedings are at the stage of final arguments and the mandate expires on 30.06.2025. In both the petitions, extension of the mandate is sought upto 31.12.2025.

in both the petitions on behalf of NHAI and, on instructions, submits that NHAI has no objection to the mandate being extended. 6.

Accordingly, with the consent of the parties, mandate of the Arbitral Tribunal in O.M.P.(MISC.)(COMM.) 451/2025 is extended upto 31.12.2025 from 09.07.2025 and in O.M.P.(MISC.)(COMM.) 452/2025, the mandate is extended upto 31.12.2025 from 01.07.2025.
