The present petition has been filed under Section 29A of the Arbitration and Conciliation Act, 1996 ('A&C Act'), seeking extension of the mandate of the Arbitral Tribunal in respect of the ongoing arbitration proceeding before Hon'ble Justice J.R. Midha (Former Judge, Delhi High Court), Ld. Sole Arbitrator, arising out of a commercial dispute between the petitioner and the respondent.

Pursuant to the orders of this Court dated 03.06.2022, the disputes between the parties were referred to arbitration under the aegis of the Delhi International Arbitration Centre (DIAC), and Justice J.R. Midha was appointed as the Sole Arbitrator.

It is stated that although pleadings in the matter were concluded on 10.10.2022. Thereafter, the parties sought and were granted liberty to lead oral evidence, which contributed to procedural delay. The arbitral mandate was previously extended vide order dated 03.05.2024 passed in OMP.(MISC.)(COMM.) 360/2024, for a period of one (1) year up to 10.04.2025.

It is stated that final arguments concluded on 09.04.2025 and the matter was listed on 17.05.2025 for clarificatory submissions, if any, or for pronouncement of the award.

It is stated that the present petition is being preferred in furtherance of the order dated 09.04.2025 passed by the Ld. Sole Arbitrator, wherein the parties were directed that an appropriate application for extension of the arbitral mandate be filed before the Competent Court, as the existing mandate is due to expire on 10.04.2025.

The present application is accordingly filed, with the express consent of the Respondent, seeking extension of the mandate by a further period of three months for passing of a reasoned and just award. 7.

Issue notice. Learned counsel Mr. Varun Shankar, for the respondent accepts notice.

He states that he has no objection to the relief sought in the present petition and joins the request for extension of the arbitral mandate. 9.

This Court has perused the record and considered the submissions. In view of the joint request of the parties, the mandate of the Ld. Sole Arbitrator is extended by a further period of six (6) months with effect from 01.06.2025 till 01.12.2025.

Accordingly, the present petition is disposed of.
