On 21.07.2025, this Court had taken note of the fact that the Order dated 25.03.2025 has yet not been complied with inasmuch as the LRs of the Defendant No.2 had not been brought on record due to which the proceedings in the present suit stood abated and further costs of Rs. 14,000 in total had to be paid by the Defendant No.2. This Court had also noted that in case that the said Order had not been complied with within three days, the present Suit should be dismissed for non-prosecution. 2.

Pursuant to that the matter was listed for 28.07.2025 but it did not reach and was listed for 10.12.2025 i.e., today. 3.

In the meantime, the matter was also listed before the learned Joint Registrar for making an endeavour to settle the matter through mediation. 4.

Today, learned Counsel for the Plaintiff states that the proceedings against Defendant No.2 stands abated and that they are now taking steps to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. bring the LRs on record. She further states that costs of Rs.14,000/- will be paid today during the course of the day itself provided that learned Counsel for the Plaintiff provides the details of the bank account. 5.

The Plaintiff is present in Court today, however, vide Order dated 21.07.2025, it was made clear that if the Order dated 25.03.2025 was not complied with within three days, the suit will be dismissed for nonprosecution. 6.

The Registry could not have listed the matter on subsequent dates since the suit would have been dismissed for Non-Prosecution without reference to the Court. This Order cannot be ignored and the suit was, therefore, wrongly placed on the subsequent dates. The present suit, therefore, be treated as dismissed for non-prosecution. 7.

It is open for the Plaintiff to move an application for the restoration of the suit after the costs of Rs.14,000/- are deposited in the bank account of the learned Counsel for the Defendant Nos. 1, 4 and 5 by the learned Counsel for the Plaintiff.
