The present petition has been filed by the petitioner seeking refund of interest free security deposit (IFSD) of a sum of Rs.49,21,344 paid by the petitioner for the license agreement with the respondent / DMRC dated 24.06.2024. The said license agreement was in respect of Shop No. 1,2 & 3 at Ground Floor of New Delhi Metro Station of Airport Express Line. 2.

Learned senior counsel for the petitioner submits that after filing of the present petition, a letter dated 23.04.2025 has been issued the respondent / DMRC which reads as under:

"Sub: License Agreement to licensing of Shop No. 1,2 & 3 at Ground Floor of New Delhi Metro Station of Airport Express Line. Reg: Transfer of IFSD amount of Rs.42,57,935/- in the Kotak Mahindra Bank (Account No. 7211203114).

Dear Sir, With reference to above cited subject, it is to inform that following account detail is available with DMRC:

Kotak Mahindra Bank Copy of cheque detail is attached for reference. After final settlement of account of M/s A27 Tradelinks Pvt. Ltd. an amount of Rs.42,57,935/- was vetted for refund. In this regard, it is requested to either confirm the aforesaid bank account detail or share any bank account detail else, after seven days, said IFSD amount shall be deposited in the abovementioned bank account."

Learned senior counsel for the petitioner confines himself to seeking that the aforementioned amount, which has been admittedly found payable by the respondent / DMRC, be released to the petitioner for now. He further seeks leave to make a representation to the respondent for release of the remaining / balance amount.

The above suggestion of learned senior counsel for the petitioner is reasonable. Accordingly, the present petition is disposed of in the above terms.

Petitioner would at liberty to approach the DGM (Property BusinessII), DMRC, who has addressed the aforesaid communication, for release of the aforesaid amount.

In case the petitioner is aggrieved by the outcome of its representation for release of the balance amount, it shall be at liberty to avail appropriate remedies under law.
