% 18.05.2016 This is an appeal against the order dated 18.11.2015 passed by a learned Single Judge of this Court, whereby the learned Single Judge has directed the closure of the right of defendant Nos. 1-4/ appellants herein to file the written statement. The Registry was also directed to remove the written statement of defendant Nos. 1-4 from the record as also the counter-claim filed by them.

After hearing the counsel for the parties, it is agreed that on payment of costs of ₹ 1 lac to the respondent No.1/plaintiff, the written statement of the appellants/defendant Nos. 1-4 shall remain on record. The counter-claim would also remain on record, provided appropriate court fee is paid within one week from today. Since the progress in the suit would have to be re-scheduled, we direct that the matter be listed before the learned Single Judge for this purpose on 27.05.2016. The appeal stands disposed of.
