Petitioner is defending a petition seeking divorce filed by his wife and is aggrieved by order dated 05.06.2024 whereby he has been directed to handover the custody of his child to his wife on 10.06.2024 and then to collect the child back on 21.06.2024 from the same place. 2.
When this matter was matter was taken up on 20.11.2024, learned counsel for the respondent had submitted that the present petition had become infructuous as the petitioner was only challenging order dated 05.06.2024 whereby the learned Judge, Family Court had granted interim custody of the minor child during the summer vacation. 3.
The petitioner himself has now moved an application seeking withdrawal of the present petition. It is also submitted in the application that since the present petition has become infructuous, the petitioner is no longer interested in pressing the same.
