% 27.09.2016 Learned counsel for the petitioners submits that the affidavit by way of evidence of the petitioner has already been filed. However, he submits that an objection has been raised by the respondent about late filing of the affidavit. He submits that in case, the objection is withdrawn and the trial court is requested to expedite the disposal of the matter, he would not press the present petition.

Leaned counsel for the respondent submits that he would have no objection if the affidavit by way of evidence is taken on record. He also submits that he has no objection to the direction to the trial court for early disposal of the matter.

Keeping in view the above circumstances, the present petition is disposed of. The trial court is requested to expeditiously deal with the matter preferable within six months.
