The factual matrix of the present petition are already incorporated in the previous order dated 21.06.2024 passed by the learned Single Judge (Vacation Bench). The same may be read as a part and parcel of the order passed today.

Suffice to state that on the last date of hearing, a concession was afforded by the learned counsel for respondent No.2 that they would allow the petitioner 21 days to file the representation and this period be reckoned from 04.06.2024. It appears that some representation has already been preferred by the petitioner on 07.06.2024. cannot be counted backward from 04.06.2024 and they should be afforded to submit their representation in 21 days, which be reckoned from 21.06.2024.

Having heard the learned counsel for the parties and as conceded at the Bar, it is provided that the petitioner may submit an additional representation within seven days from today. The same may be considered by the respondent in accordance with the law. Till then, no adverse action shall be taken in terms of the impugned show-cause notice/e-mail dated 04.06.2024.

In view of the aforesaid disposition, the learned counsel for the petitioner requests that the petitioner may be allowed to withdraw the present petition. Learned counsel for respondent No.2 has no objection. The same is allowed to be dismissed as withdrawn without prejudice.

The petitioner shall be at liberty to approach the competent forum in case there is any further grievance. 6.

The petition is disposed of accordingly.
