O R D E R

The present proceedings are instituted under Section 482 Cr.P.C. seeking quashing of FIR No. 339/2020 registered under Sections 229/337 IPC at P.S. Delhi Cantt., Delhi on the ground that the parties have amicably settled their disputes.

As per the allegations levelled in the FIR, the petitioner, who was driving his motorcycle negligently, caused injuries to respondent No.2. 3.
Mr. Jha, learned APP for the State, on instructions, submits that in the present FIR petitioner is the only accused and respondent No.2 is the complainant/victim.

Learned counsel for the petitioner submits that parties have settled their disputes on 22.07.2023 before the Delhi Mediation Centre, Patiala House Court, New Delhi. demand draft bearing No. 788501 dated 24.05.2024 drawn on State Bank of India, Palam Colony, Delhi today. In terms of the settlement, the complainant is now left with no claim or grievance whatsoever against the petitioner.

Petitioner, who is present in Court, has been identified by his counsel as well as by the I.O./SI Anil, Delhi Cantt. Respondent No.2, who is also present in Court, has been identified by the I.O. 6.
Petitioner has shown remorse for the incident and undertakes not to repeat the same in future. Respondent No. 2, states that he has entered into the settlement with the petitioner out of his own free will, volition and without any coercion. He also states that he has no objection if the present FIR and consequent proceedings are quashed.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed, subject to payment of cost of Rs.20,000/- to be paid to respondent no.2 by way of a demand draft through the IO within four weeks from today. 9.
Proof evidencing receipt of payment of cost shall be filed with the I.O. If the proof is not filed within stipulated period, the I.O. shall be at liberty to move an appropriate application.
