The present appeal is filed under section 19 of the Family Court Act, 1984 read with section 42 of the Guardianship and Wards Act. 2.
The appellant, who happens to be the father of the child in question has impugned order dated 30.05.2024 whereby the learned Trial Court had directed the mother of the child to bring the minor child to the Children Room situated at Tis Hazari Courts, Delhi on 07.06.2024 so that the appellant could meet him. 7th June, 2024 also happened to be the birthday of the appellant.

Our attention has been drawn towards the application which the appellant had moved before the learned Trial Court. In such application, the appellant had, inter alia, sought the custody of the child for half of the summer vacation.

Fact remains, the impugned order does not talk about grant of any visitation right during the summer vacation.

During the course of the arguments, the learned counsel for the appellant stated that the appellant would not have any objection if visitation right for only two days, qua the left over summer vacation period, is granted to the appellant on the same terms and conditions as mentioned in the impugned order. Said proposal has been conveyed to the learned counsel for the respondent and learned counsel for the respondent, after taking necessary instructions from the respondent who is present in the Court, has agreed to the same.

Keeping in mind the facts of the case and with the consent of the parties, present appeal stands disposed of with direction that respondent would bring the minor child on 21.06.2024 and 28.06.2024 from 03:00 P.M. to 07:00 P.M. to the Children Room situated at Tis Hazari Courts, Delhi so as to enable the appellant meet her.

The present appeal stands disposed of in view of the above directions. DR.
