O R D E R

The present applications have been filed by the petitioners/applicants seeking anticipatory bail in FIR No. 14444/2024 registered under Section 379 IPC at P.S. Mundka, Delhi.

The applicants being father and son are represented by a common counsel who has addressed common submissions, hence these bail applications are disposed of by a common order. 3.

prosecution, the complainant was lured by the co-accused to hand over his truck bearing registration number HR-73A-1189. The only allegation against the present applicants is that a part of the truck in question was found in the premises owned by the present applicants. He submits that neither did the applicants come in contact with the complainant nor did they lure him to part with the property.

Mr. Sanjeev Sabharwal, learned APP for State on the other hand has opposed the bail applications. He submits that during investigation, Section 420/34 IPC has been added. He on instructions from the IO, submits that it was the co-accused Iftikhar who had initially contacted the complainant and lured him to part with the truck. He on instructions further submits that the applicants are not involved in any other case. 5.
Considering the role attributed to the present applicants is of being in possession of one part of the stolen truck, it is directed that in the event of arrest, the applicants be released on bail subject to their furnishing personal bonds in the sum of ₹25,000/ - with one surety each of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the applicants shall provide their mobile numbers, which they undertake to keep operational at all times during the pendency of the trial.
(ii) The applicants shall join the investigation as and when asked. (iii) The applicants shall inform the concerned Investigating Officer about their current residential address.

applicants shall promptly inform the same to the concerned Investigating Officer/SHO.
(v) The applicants shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.
(vi) The applicants shall regularly appear before the trial Court. 6.
The applications are disposed of in the above terms. 7.
Needless to state that nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present bail applications.
