% 06.09.2019 CRL.M.A. 35310/2019 (exemption) Allowed, subject to all just exceptions.

BAIL APPLN. 2235/2019 The present application has been filed by the petitioner for grant of anticipatory bail.

Learned counsel for the petitioner has submitted that co-accused Shahnoor has already been granted bail vide order dated 02.08.2019. As per allegations in the FIR, co-accused and the petitioner have snatched a golden chain of the complainant. The allegations against the petitioner/accused Saleem are that he had only beaten the victim Arun. Learned counsel for the petitioner states that the petitioner will join the investigation as and when required.

Learned APP for the State opposes the anticipatory bail application on the ground that four other cases are pending against him and NBWs have also been issued against him.

Heard. Keeping in view of the fact that the co-accused Shahnoor has already been granted bail vide order dated 02.08.2019 and also keeping in mind the fact that FIR has been registered on 25.04.2019, whereas the incident had occurred on 19.03.2019, it is hereby ordered that in the event of arrest of the petitioner, he be released on bail on his executing personal bond in the sum of Rs. 15,000/- with one surety of the like amount to the satisfaction of the SHO/IO. Petitioner is directed to join the investigation as and when required.

The bail application stands disposed of.
