The present application is filed under section 439 Cr.P.C. on behalf of petitioner/applicant Mohit Ahuja for grant of interim bail in FIR bearing no. 0170/2024 registered at P.S. Kashmere Gate under section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985.

The counsel for the petitioner/applicant stated that the daughter of the petitioner/applicant who is five months old is not well since 18.05.2024 and was suffering from loose motions, vomiting and mild fever. The wife of petitioner/applicant was advised by the doctor to take the daughter to Kalawati Hospital which is situated very far away from the house of the petitioner/applicant. In these circumstances, it is prayed that the petitioner/applicant be released on interim bail for 30 days. 7.

The Additional Public Prosecutor for the respondent/State stated that the application filed on behalf of the petitioner/applicant for grant of interim bail was dismissed vide order dated 03.06.2024 passed by the court of Ms. Ekta Gauba Maan, Link Judge to Special Judge, NDPS-02, Central, Tis Hazari Courts by observing that no ground for granting bail is made out. 8.

The daughter of the petitioner/applicant is stated to be suffering from mild fever, loose motions and vomiting. The medical documents submitted on record on behalf of the petitioner/applicant are not indicating any serious illness.

After considering all the facts, no ground for interim bail is made out. Accordingly, the present application is dismissed. DR.
