By way of present application, the applicant/petitioner seeks anticipatory bail in case FIR No.0466/2023 registered under Sections 420/419/467/468/471/120B IPC at PS Kapashera, Delhi now transferred to DIU/South West District, Delhi.

Mr. Anurag Ahluwalia, learned counsel appearing for the applicant states that without prejudice to his rights and contentions, the applicant undertakes that not only applicant hand will over the possession of the property in question to the complainant within three days but also undertakes not to claim any right, title or interest over it. He further submits that the applicant is 70 years old and is suffering from various ailments. He further submits that the applicant has already joined investigation on multiple occasions and lastly on 04.07.2024. He on instructions states that the applicant has been issued notice under Section 41A Cr.PC and under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Section 91 Cr.P.C. The undertaking given on behalf of the applicant is accepted and is taken on record and in acknowledgement of the same, the applicant as well as his counsel has signed the order-sheet. 3.
At this stage, Mr. Ahluwalia submits that in pursuance of the notice received under Section 91 Cr.P.C, the applicant has already provided the documents to the IO.

Considering the aforesaid and the undertaking given on behalf of the applicant, the interim protection granted to the applicant vide order dated 01.07.2024 is made absolute and it is directed that in the event of arrest, the applicant be released on bail subject to his furnishing a personal bond in the sum of ₹25,000/ - with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the applicant shall provide the mobile number, which he undertakes to keep operational at all times during the pendency of the trial.
(ii) The applicant shall join the investigation as and when asked. (iii) The applicant shall inform the concerned Investigating Officer about his current residential address.
(iv) In case of change of residential addresses/contact details, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO. (v) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.
(vi) The applicant shall regularly appear before the trial Court. 5.

Needless to state that nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present bail application.
