The present application is filed under section 439 Cr.P.C. for extension of interim bail which was granted for period of 02 weeks vide order dated 03.06.2024 in FIR bearing no.0609/2023 registered at P.S. Subhash Place under sections 302/34 IPC on the ground of scheduled surgery of the wife of the petitioner/applicant. 4.

postponed due to dehydration caused by food poisoning. In these circumstances, it is prayed that the petitioner/applicant be granted extension of the interim bail for another 06 weeks.

The Status Report is filed on behalf of the respondent/State wherein it is stated that in view of the condition of the wife of the petitioner/applicant, she was advised to undergo surgery which is scheduled on 26.06.2024 and for the purpose of surgery, she has to be admitted in hospital on 25.06.2024. Let the Status Report be placed on record. It is further stated that the petitioner/applicant was implicated in a case pertaining to offence punishable under section 302 IPC and the eye witnesses are yet to be examined. In these circumstances, further extension of the interim bail is opposed.

The perusal of Status Report reflects that the surgery of wife of the petitioner/applicant is scheduled on 26.06.2024 and she is required to be admitted in hospital on 25.06.2024. On being asked, the Investigating Officer, Inspector Manoj Dalal, P.S. Subhash Place stated that the petitioner has not extended threat to any of the eye witnesses of the offence. 9.

After considering all facts, the interim bail of the petitioner is extended till 07.07.2024 on the terms and conditions as imposed vide order dated 03.06.2024.
