The Petition under Section 439 read with Section 433 and 434 of the Companies Act, 1956 read with Rule 9 of the Companies (Court) Rules, 1959 has been filed on behalf of the Petitioner for winding up. 2.

Learned counsel on behalf of the Petitioner, on instructions, submits that she be allowed to withdraw the present Petition since the Company has already gone in liquidation and IRP has also been appointed. 3.

The Petition is permitted to be withdrawn. The Petitioner is at liberty to appear before the IRP, in accordance with law. 4.

The Petition is disposed of accordingly.
