Application under Order 9 Rule 9 filed for restoration of MAC.APP.301/2022. It is submitted that on 08.07.2024 there were two matters of the learned counsel on account of which he could not appear in this case on time. It is submitted that the non-appearance is neither intentional nor deliberate. He was unable to appear, therefore, the impugned order dated 08.07.2024 vide which the appeal has been dismissed in default be set aside.

The record shows that on 08.07.2024 neither petitioner nor respondent appeared for the reasons stated in the application. 3.

The application is allowed and the petition is restored to its original number.
