The petitioner has already challenged the impugned action before the Appellate Tribunal-MCD. However, the post of Presiding Officer of Appellate Tribunal-MCD is lying vacant. The petitioner, therefore, seeks to withdraw the instant petition subject to the protection being given till the decision on his interim application is taken by the Appellate Tribunal-MCD. 2.

In view of the aforesaid, the petition stands disposed of as withdrawn. 3.

However, it is directed that till the application for interim relief filed by the petitioner or to be filed, is disposed of by the Appellate TribunalMCD, no coercive steps shall be taken by the respondent. All rights and contentions of the parties are left open.
