The present Writ Petition under Article 226 read with Section 482 C.r.P.C has been filed on behalf of the petitioner seeking emergency Parole for the period of 60 days.

It is submitted that the father of the petitioner has expired on 04.06.2024. The petitioner had already undergone incarceration of about 09 years and 05 months without remissions out of the rigorous imprisonment for life and fine.

It is submitted that the last rites of the father have been performed on 05.06.2024 and the Tervi ceremony had been performed on 16.06.2024. 4.
The mother of the petitioner is old and aged and needs emotional support and therefore, the Parole may be granted for a period of 6 weeks. 5.
Learned standing counsel appearing on behalf of the State has filed a Status Report, which be taken on record.

petitioner has died but all the requisite ceremonies have been done. There survives no ground for the emergency parole.

The petitioner is suffering rigorous life imprisonment for the offences under Section 302 IPC. He has also been convicted under FIR No. 1170/2014and 922/2014 under Section 302 IPC.

The emergency Parole sought on the ground that the father of the petitioner has died and his last rites have to be performed. However, as submitted, the Tervi ceremony has also been performed on 16.06.2024. The ground on which the emergency Parole has been sought does not survive. Since there is no ground for grant of emergency parole, the Petition is hereby dismissed.
