% 18.01.2024 Learned counsel appearing for the parties submit, that vide order dated 15.01.2024 made by this court in ARB.P. No.52/2024 titled Shri Sukhraj and Ors. vs. Puri Construction Private Limited and Ors., this court has appointed Hon'ble Mr. Justice S. Ravindra Bhat, former Judge of the Supreme Court of India, as the learned Sole Arbitrator to adjudicate upon the disputes between the parties. 2.
Mr. Sanjeev Kumar Sharma, learned counsel appearing for the petitioners submits, that the present petition under section 9 of the Arbitration & Conciliation Act, 1996 ('A&C Act') be placed before the learned Sole Arbitrator, to be considered as an application under section 17 of the A&C Act; and to be decided in accordance with law. In the circumstances, the present petition is disposed-of, permitting the petitioners to place the present petition before the learned Arbitrator as an application under section 17 of the A&C Act, alongwith the replies filed thereto; with a request to the learned Arbitrator to decide the application on the same pleadings as made before this court, in accordance with law.

It is further directed, that in the meantime, interim order dated 18.09.2023, as clarified vide order dated 20.09.2023, made in the matter shall continue, till the learned Arbitrator decides the application under section 17 of the A&C Act.

It is made clear that this court has not expressed any opinion on the merits of the disputes between the parties.

The petition stands disposed-of in the above terms. 7.
