The present application has been filed under Section 439 of the Code of Criminal Procedure, 1973 ("Cr.P.C.") for grant of interim bail for a period of three weeks to the applicant/accused in FIR No. 205/2023, at Police Station, Crime Branch, New Delhi.

Learned counsel appearing for the petitioner submits that the petitioner is suffering from an acute heart ailment since the year 2021 and therefore, it is imperative that he may be granted interim bail, for the purposes of his treatment.

The present matter was listed for hearing on 24th June, 2024, when learned Additional Public Prosecutor had taken time to seek instruction. 4.

Today, Dr. Krishnandan Kumar, Senior Medical Officer from Jail No.4, Central Jail, Tihar Jail, has joined this Court through Video Conferencing.

He re-affirms the fact that the petitioner is suffering from heart ailments, and needs medication and other treatment. 6.

Accordingly, considering the submissions made before this Court, the petitioner is admitted to interim bail for a period of three weeks, subject to the following conditions:

i) The Petitioner shall furnish a personal bond in a sum of ₹25,000/ - with a surety of like amount to the satisfaction of the CMM/DMM/MM. ii) Petitioner shall remain available on the address, i.e., Plot No. 137, 4th Floor, Village Amberhai Sector-19, Dwarka, New Delhi-110075, throughout the period of interim bail, and shall not change the same. iii) The petitioner shall remain available on the mobile number 8800116568. The petitioner shall keep his mobile number operational throughout the period of interim bail.

iv) The petitioner shall not leave the National Capital Territory of Delhi. v) In case of change of mobile number, the petitioner shall intimate the same to the Investigating Officer ("IO")/Court concerned, by way of an affidavit.

Copy of the order be forwarded to the concerned Jail Superintendent, for necessary compliance and information.
