The present application has been filed under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 ("Cr.P.C.") on behalf of the petitioner seeking interim bail for 45 days in FIR No. 55/2019, registered under Sections 302/307/201/34 IPC and Sections 25/27 of the Arms Act, at Police Station, Inderpuri.

The petitioner has sought interim bail in order to arrange sufficient funds, and care for his wife, Smt. Nisha, who has been advised by the doctors to undergo spinal surgery involving L2-L3 and L4 decompression and fixation.

It is submitted that the said surgery is fixed for 29th June, 2024 and the wife of the petitioner is to be admitted on 28th June, 2024.

Public Prosecutor for the State had sought time to file Status Report. 5.

Today, Mr. Laksh Khanna, learned Additional Public Prosecutor for the State has handed over copy of the Status Report, wherein, the fact of surgery of the petitioner's wife, has been confirmed. The said Status Report is taken on record.

Accordingly, the petitioner is admitted to interim bail for a period of 45 days on the following terms and conditions: i) The Petitioner shall furnish a personal bond in a sum of ₹25,000/ - with a surety of like amount to the satisfaction of the Duty MM/Duty Session Judge/Trial Court.

ii) Petitioner shall remain available on the address, i.e., House No. B360, Budh Nagar, JJ Colony, Inderpuri, Delhi, throughout the period of interim bail, and shall not change the same.

iii) The petitioner shall remain available on the mobile number 9971018989. The petitioner shall keep his mobile number operational throughout the period of interim bail.

iv) In case the surgery of the wife of the petitioner does not take place, the petitioner shall surrender to the Jail Authority, forthwith. iv) The petitioner shall not leave the National Capital Territory of Delhi. v) In case of change of mobile number, the petitioner shall intimate the same to the Investigating Officer ("IO")/Court concerned, by way of an affidavit.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
