The present application has been filed by the counsel for the plaintiff for seeking discharge in the suit.

Learned counsel for the plaintiff submits that his client has not been contacting him for a long while and he has addressed a notice of discharge to the plaintiff on 30.09.2015, which was dispatched by speed post. In the said letter, he had called upon the plaintiff to make suitable arrangements for appearing in the Court today. Learned counsel states that despite the said notice, the plaintiff has not contacted him.

For the reasons stated in the application, the same is allowed. Counsel for the plaintiff is discharged from the present case. 4.
The application is disposed of.

As none is present on behalf of the plaintiff despite notice dated 30.09.2015 served on him by his counsel, it is assumed that the plaintiff does not wish to pursue the present suit, which is accordingly dismissed for non-prosecution.
