% 29.08.2024 1.

This hearing has been done through hybrid mode. 2.

The present petition under Article 226 of the Constitution of India has been filed by the Petitioner- Pradeep seeking issuance of a writ of habeas corpus directing the Respondent Nos.1 and 2 to release the Petitioner's wife i.e., Respondent No. 3 from illegal custody and produce her before this Court. 3.

On 5th July, 2024, a status report was handed over and the same was taken on record. As per the said status report, the Respondent No.3 was stated to be residing with her father Respondent No.2-Mr. Nain Singh in Kanpur, UP. The police had been informed that Respondent No. 3 is the real cousin of the Petitioner. On the said date, this Court had directed to produce the girl today.

4.

Today, the Petitioner is present. Respondent No. 3 has also appeared before the Court along with her father i.e., Respondent No.2. 5.

The case of the Petitioner is that he had married Respondent no.3 in May 2024. However, the girl states that she was forced into marriage. The girl along with her father, Mr. Nain Singh, has appeared before this Court, and submitted that they are residing in Delhi, but they hail from Kanpur, Uttar Pradesh.

6.

Be that as it may, the girl in her interaction with this Court in Chamber has stated that she does not want to go with the Petitioner. Considering the fact that the Respondent No. 3 is a major and she does not wish to join the company of the Petitioner, and wishes to go back with her father i.e., Respondent No. 2, no further orders are called for in this petition. 7.

The present petition is disposed of in the aforesaid terms. 8.

Pending applications, if any, also stand disposed accordingly. PRATHIBA M. SINGH, J.

AMIT SHARMA, J.
