This application has been moved on behalf of the applicant/accused seeking regular bail under Section 439 of the Code of Criminal Procedure, 1973.

Learned APP for the State is present. However, Investigating Officer (IO) is not present.

This application can be considered without any further material. It is the case of prosecution that the applicant/accused is alleged to have gone to United States of America based on forged and fabricated travel documents including Passport and he was apprehended by the immigration officials and thereafter deported to India. The applicant/accused is in judicial custody since 07.05.2004. He is about 26 years of age and his otherwise stated to be holding a Indian Passport. No useful purpose would be served in keeping him under in judicial custody any further.

In view of the above, the present application is allowed and The applicant/accused is admitted to bail on his furnishing a personal bond in the sum of Rs. 25,000/- with one surety in the like amount to the satisfaction of the concerned learned MM/Link MM/Duty MM. 9.

The application is disposed of.
