% 11.09.2019 Crl. M. A. 35551/2019 (exemption) Allowed, subject to all just exceptions.

W.P.(CRL) 2545/2019 The petitioners have filed the present petition under Article 226 of the Constitution of India read with Section 482 of Code of Criminal Procedure, 1973 (Cr.P.C) for quashing of FIR No. 978/2018, under Sections 498A/406/34 of Indian Penal Code, 1860 ('IPC'), registered at Police Station- Sultanpuri, Delhi and the proceedings emanating therefrom. The petitioners and respondent no.2 as well as their respective counsels submit that the parties have settled their disputes on their own free will, without any pressure or coercion.

Respondent no.2, who is present in Court, has reiterated the aforesaid facts and submits that she is living with her husband/petitioner no.1 for the last about 2 months. She further states that she has no objection if the FIR is quashed and the petition is allowed.

The Investigating Officer, who is present in Court, has identified the petitioners as well as respondent no.2 and has also verified the settlement. In view of the settlement arrived at between the parties and the fact that petitioner no.1 (husband) and respondent no.2 (wife) are living happily , no fruitful purpose would be served in keeping the parties entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 978/2018, under Sections 498A/406/34 of Indian Penal Code, 1860 ('IPC'), registered at Police Station- Sultanpuri and the proceedings emanating therefrom are quashed.

Petition stands disposed of accordingly.
