O R D E R
% 03.05.2016 The petitioner in terms of the directions contained in the order dated 09.02.2016 undertakes to handover the vacant and physical possession of the suit property i.e. second floor of D-58, Malcha Marg, Chankyapuri, New Delhi to the landlord on 08.05.2016 at 10:30 am. Both the parties will appear in person on the said date at the suit property/or through their authorized representative where the actual handing over the suit property will be made by the petitionertenant to the landlord. This Court has been informed that the keys of the premises are lying deposited with the Trial Court. The Trial Court shall handover the keys to the Bailiff who shall be present at the spot for the aforenoted limited purpose.
The parties are not ad idem on user charges which have to be paid by the tenant to the landlord; the dates mentioned by the respective parties appear to be contrary to their counter submission. Accordingly, since the matter is fixed before the Trial on 31.05.2016, the Trial Court shall proceed to decide this issue.
