Mr. Jasmeet Singh, appearing on advance notice on behalf of the Respondent, informs the Court that in terms of the policy of the Directorate General of Recruitment, the Petitioner, who holds NCC 'C' Certificate, falls in priority 5. Therefore, although, he may have cleared the physical and medical tests, he figures at Sr. No.412. Apparently, the list stood exhausted at Sr. No.257 itself.

3. In view of the above, no relief can be granted to the Petitioner.

4. The petition and the pending application are dismissed.
