O R D E R

% 27.05.2025 I.A. 13650/2025 (Under Order XXIII Rule 3 CPC) 1.

This is a joint application filed under Order XXIII Rule 3 of Code of Civil Procedure, 1908 ('CPC'), filed by the parties, seeking passing of decree in term of Memorandum of Settlement ('Settlement Agreement') dated 24.05.2025 executed between the parties. 2.

The above-captioned suit has been instituted by the plaintiff seeking a decree of permanent injunction restraining defendant no. 1, her relatives, associates, agents, and employees from entering or interfering with the plaintiff's possession, peaceful residence, and enjoyment of the property The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is stated that during the pendency of the present suit, with the intervention of family members and well-wishers, the parties have amicably resolved their disputes. The parties have entered into a Settlement Agreement dated 24.05.2025, which is placed on record along with this application, which comprehensively records the terms and conditions of the settlement agreed between the parties.

Plaintiff, defendant no. 1 and defendant no. 2 have joined the proceedings through Video Conferencing link and are identified by their respective counsels.

This Court has perused the terms of the Settlement Agreement dated 24.05.2025 and interacted with the plaintiff, defendant no. 1 and defendant no. 2. The parties confirm that they have entered into the settlement agreement voluntarily, after obtaining legal advice, and undertake to remain bound by its terms.

Defendant No. 1 has also confirmed execution of the letter dated 24.05.2025, which is placed on record along with application, recording the handover of possession of the suit property to the plaintiff. 7.

Learned senior counsel for the plaintiff, as well as learned counsel for defendant nos. 1 and 2, state that the settlement has been duly negotiated and the parties are satisfied with its terms and the reasonableness of the arrangement.

This Court is satisfied with the compromise between the parties contained in the aforesaid Settlement Agreement dated 24.05.2025 and is of the opinion that it satisfies the requirements of Order XXIII Rule 3 CPC. find any impediment in decreeing the captioned suit in terms of the said agreement.

Accordingly, the suit is decreed in terms of the Memorandum of Settlement dated 24.05.2025.

The Registry of this Court is directed to prepare a decree in terms of this order and it is directed that the Settlement Agreement shall form part of the said decree.

The parties shall remain bound by the terms and conditions recorded in the Settlement Agreement.

12.

All pending applications stand disposed of.

13.

Interim orders, if any, shall stand merged with this order and the terms of settlement.

14.
