The present writ petition has been filed seeking directions to the respondent no. 1 to cancel the Sanctioned Building Plan dated 02nd February, 2021, obtained by respondent nos. 2 and 3, in connivance with respondent no. 4, under the Saral Scheme bearing online ID No. 10083438 for the property bearing House No. 29-A, Khasra No. 121 Min, Shera Mohalla, Main Market, Village Garhi, Jharia Maria, New Delhi-110065. 2.

At the outset, learned counsel appearing for the petitioner submits that he shall be satisfied, if the present writ petition is considered as a representation, before the Municipal Corporation of Delhi ("MCD"). 3.

submits that the petitioner has filed other similar petitions, wherein, such submissions as made by the petitioner in the present petition, have not been entertained.

He further submits that the MCD has already inspected the property of the petitioner and has found the Sanctioned Building Plan of the petitioner to be valid.

Learned counsel appearing for respondent nos. 2 and 3 further submits that the petitioner has not approached this Court with clean hands. 6.

All these aspects shall be considered by the MCD at the time of deciding the representation made by the petitioner. 7.

Accordingly, considering the submissions made before this Court it is directed that present writ petition shall be treated as representation by the MCD. At the time of considering the representation of the petitioner, an opportunity of hearing shall be granted to respondent nos. 2 and 3. 8.

Respondent nos. 2 and 3, along with the petitioner, shall be allowed to appear before the concerned official of the MCD to make their respective submissions, and submit their respective documents, before the concerned official of the MCD.

The reply and documents, as may be submitted by the petitioner and respondent nos. 2 and 3, shall be duly considered by the MCD. Thereafter, a Speaking Order shall be passed by the MCD, with respect to the representation of the petitioner.

In case, any of the parties are aggrieved by the Speaking Order to be passed by the MCD, they shall have the liberty to seek their remedies, in accordance with law.
