The instant petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the petitioner seeking the following reliefs: "(i) Directing the Deputy Commissioner Police, Hauz Khas, New Delhi to constitute an Internal Complaints Committee · (ICC) for redressal of present sexual harassment complaints in accordance with the guidelines laid down by the Hon'ble Supreme Court in Vishakha versus The State of Rajasthan (1997) 6 SCC 241 and the Sexual Harassment at Workplace· and Sexual harassment of women at workplace (Prevention, Prohibition and Redressal) Act, 2013.

delinquent police officer is suitable to be retained in service in F.I.R. bearing no. 467/2021 dated 03.08.2021 U/s 376 and 506 IPC, 1860 registered at Malviya Nagar Police Station, South District, New Delhi DD no.65A Dated 07.08.2022. (iii) Directing immediate suspension of a delinquent police officer in order to ensure a free and fair investigation, and trial and for the safety of the Petitioner.

(iv) Directing any other order/direction(s) as this Hon'ble Court deems fit and proper in the facts and circumstances of the present case and in the interest of Justice." 2.

Mr. Rahul Tyagi, learned ASC appearing on behalf of the State submitted that all the prayers made in the instant petition have already been taken into consideration except for the prayer no. (iii). Therefore, he prayed that the instant petition may be disposed of as nothing survives for further adjudication in the matter.
