W.P.(C). 408/2016 This is a petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. moved by the petitioners for quashing of FIR No.918/2015 registered at Police Station Farsh Bazar, Delhi under Sections 341/323/506/354/34 IPC and the consequent proceedings arsing therefreom on the ground that the parties have settled all their disputes.

It is submitted by learned counsel for the petitioners that there are multifarious litigations between the parties. They have settled all their disputes before the mediation centre, Karkardooma Courts, Delhi. The settlement arrived at between the parties is annexed to the petition as Annexure A-3. The parties have also entered into a compromise and the compromise deed is at pg. 27. The respondent No.2/complainant is present in person (duly identified by the Investigating Officer and her counsel) and submits that she has amicably resolved all disputes with the petitioners voluntarily without there being any threat, coercion or

pressure of any sort and in view of the settlement arrived at between the parties, she does not want any action against the petitioners and does not have any objection to quashing of the instant FIR.

Mr Siddharth Sindu, Adv. who appears for Mr Sanjay Lao, ASC for State submits that in view of the settlement arrived at between the parties, he has no objection to quashing of FIR.

Perusal of record reveals that both the petitioners are Advocate by profession. Nine civil cases were filed by the petitioners against respondent no.2 and others. One criminal complaint was filed by respondent no.2 against petitioners. Besides that cross cases were registered against the parties. Now good sense has prevailed upon parties. With the intervention of Ms.Jaya Tomar, Mediator, Karkardooma Courts, Delhi parties have settled all their disputes pursuant to which, now respondent no.2 does not want to proceed with the case and has no objection if FIR is quashed. Ms. Jaya Tomar, Advocate deserves a word of appreciation for making efforts to resolve the disputes between the parties which as per details in the order were pending since the year 2007. Keeping in view the facts that the parties have compromised the matter with each other amicably, no useful purpose would be served by continuing the criminal proceedings against the petitioner, which will only be an exercise in futility and wastage of precious time of the Court.

Accordingly, the petition is allowed and the FIR No.12/2015 registered at Police Station Connaught Place, New Delhi under Sections 354/354D/506 IPC and consequent proceedings emanating therefrom are hereby quashed subject. The petition stands disposed of accordingly.
