The present suit for partition has been filed with respect to agricultural land situated in Village Taj Pur Kalan. 2.
Learned counsel for the plaintiff states that no notification under Section 507 of the Delhi Municipal Corporation Act, 1957 ('DMC Act') has been issued declaring the village as an urban area. 3.
In the opinion of this Court, in the absence of a notification under Section 507 of the DMC Act, the plaintiff's remedy is to approach the appropriate authority under the Delhi Land Reforms Act, 1954 ('Act of 1954') for the relief of partition. The land in the village continues to be governed by the provisions of the Act of 1954. 4.
Learned counsel for the plaintiff states that in view of the aforesaid observations of this Court he seeks permission to withdraw the present suit with liberty to file appropriate proceedings on the same cause of action before the appropriate forum in accordance with law.
