This appeal is directed against the order dated 29.05.2024 passed by the learned Judge, Family Court-01, West District, Tiz Hazari Courts, in HMA no.88654/2016.

The appellant/wife is aggrieved by the fact that although recordal of evidence concerning the respondent/husband went on for five (5) years, she was not given adequate time to place her evidence on record. 3.1 It is submitted by the counsel for the appellant/wife that some leeway was sought on account of the appellant's/wife's ill health. 3.2 That said, counsel for the appellant/wife concedes that in a Transfer Petition preferred by the appellant/wife, the Supreme Court, while refusing to grant relief, had directed the Family Court to complete the proceedings within six (6) months from the date of its order. 4.

The record shows that the Supreme Court passed its order on 08.01.2024.

Given this position, counsel for the appellant/wife, realizing the obvious difficulty faced by him, seeks to withdraw the appeal, with liberty to take appropriate remedy, albeit, as per law. 6.

The appeal is dismissed as withdrawn having regard to the submissions made before us by the counsel for the appellant/wife. 7.

Pending applications shall stand closed.
